Welcome to NicheIQ. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the service.

1. Service Description

NicheIQ is an AI-powered creator intelligence platform that provides Instagram creators with content analysis (Content DNA), multi-source trend intelligence, AI-driven chat recommendations, content auditing, and performance analytics. The service is designed to help creators optimize their content strategy and grow their audience.

2. Account Requirements

  • You must be at least 13 years old to use NicheIQ.
  • You must provide a valid email address and create a secure password.
  • To use Instagram-related features, you must connect an Instagram Business or Creator account. Personal Instagram accounts are not supported due to Instagram Graph API requirements.
  • You are responsible for maintaining the security of your account credentials.
  • You must not share your account with others or create multiple accounts for the same person.

3. Instagram Authorization

When you connect your Instagram account, you authorize NicheIQ to access your profile information, posts, and engagement metrics through the official Instagram Graph API. You may revoke this authorization at any time by disconnecting your account in Settings or through your Instagram app settings. Revoking access will stop new data collection but previously synced data will remain until you request deletion.

4. Acceptable Use

You agree NOT to:

  • Use NicheIQ for any illegal or unauthorized purpose
  • Attempt to access other users' accounts or data
  • Reverse-engineer, decompile, or disassemble any part of the platform
  • Use automated scripts, bots, or scrapers against the platform
  • Interfere with or disrupt the service or its infrastructure
  • Violate Instagram's Terms of Use or Community Guidelines through our service
  • Use the AI features to generate harmful, misleading, or illegal content

5. Intellectual Property

Your Content: You retain all rights to your Instagram content, captions, images, and videos. By using NicheIQ, you grant us a limited license to process your content solely for the purpose of providing the service (analysis, recommendations, embeddings).

Our Platform: NicheIQ's platform, including its design, code, AI models, and features, is owned by NicheIQ. You may not copy, modify, or distribute any part of the platform without our written permission.

AI-Generated Content: Content generated by our AI co-pilot (captions, hooks, recommendations) is provided for your personal use. You are free to use AI-generated suggestions in your Instagram content.

6. Service Availability

We strive to keep NicheIQ available 24/7, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any loss or inconvenience caused by service interruptions.

7. AI Disclaimer

NicheIQ uses artificial intelligence to analyze content and provide recommendations. AI-generated insights are provided "as is" and should be treated as suggestions, not guarantees. We do not guarantee that following AI recommendations will result in specific growth, engagement, or revenue outcomes. Always use your own judgment when making content decisions.

8. Limitation of Liability

To the maximum extent permitted by law, NicheIQ and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. This includes, but is not limited to, loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

9. Termination

You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior. Upon termination, your access to the platform will be immediately revoked, and your data will be deleted within 30 days.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice on our platform. Your continued use of NicheIQ after changes constitutes acceptance of the updated Terms.
